The reason for this was because they could not point to any particular damage caused to the patient. Even so, their insurance company forced them to pay their legal expenses.
The details of the case can be very complicated.
Lexus itself was not named as a defendant, nor was the insurance company that insured them. However, the company was found to have violated the terms of their policy. Their lawyers argued that the policy was designed to prevent such a situation. They pointed out that the insurance clause required that they should have a reasonable suspicion before they would be held liable for any damages.
There is nothing to indicate that such a threshold has ever been set before.
What is clear though is that these lawsuits can be extremely expensive. They can also drag on for years. This means that either party will occasionally ask for an extension. It also means that the plaintiff will have to bear legal costs in that time.
